The Most Ethical Course

I believe the most ethical course of action in the story of Felicia Robinson is to wait it out because her opponent may seem guilty at the time but he could also be an innocent man and she wouldn't want to have the stigma that she's a liar because of a mistake she has made. 3a. ) When coming across a survey showing majority of people in my state that oppose my position, I should point out those shortcomings that came my way during my the process because it will show that I'm a honest person, the people love honesty ! b. ) In my opinion,I believe the most ethical course of action when listening to an informative speech that is given by a classmates that has plagiarized is to talk with the speaker as a individual and inform them that I'm aware of their actions and strongly insist that they do not do it again, because I believe everyone deserves a second chance also I wouldn't want my fellow classmate to get hit with serious consequences over stupidity. 3c. Attitudes Towards Error Correction Essay

Introduction The present study focuses on the way in which error correction is done and the significance of errors in the Romanian context. In designing it, I did not use my knowledge on causes of errors as I was not interested to find out whether it can be established a correlation between students’ mother tongue, the target language and the production of errors. I oriented this study towards a narrower issue: the attitudes of teachers, students and native speakers of Romanian towards error correction. In order to do this, I used the following classification of correction techniques: self – correction, peer correction and teacher correction. My research instrument for finding out teachers’ and learners’ attitudes towards error correction was the questionnaire. In constructing my questionnaires my sources were David Nunan’s books entitled ‘Language Teaching Methodology. A Textbook for Teachers’ (1991) and ‘Research Methods in Language Learning’ (1995).The questionnaire is a research instrument which involves asking questions of other people and it is classified as ‘introspective’, since it involves respondents reporting on themselves, their views, their beliefs and so on. According to Nunan (1995:115) ‘introspection is the process of observing and reflecting on one’s thoughts, feelings, motives, reasoning processes, and mental states with a view to determining the ways in which these processes and states determine our behaviour’.Very often the questionnaire is answered by reading the questions and then ticking responses, or by writing in short answers. Thus, it is easier for the researcher to deal with the data collected and this is one of the reasons I chose it. The Theory of Questionnaire Design and Analysis Questionnaire preparation †¢Purpose The first thing to be very clear about was the purpose, that is, I had to know exactly the reason why I was setting up the questionnaire and what I wanted to find out. I tried to imagine the range of responses in order to know whether they would tell me what I needed to know. †¢Handling the data Again, it was important to imagine the completed responses. They needed to be in a form that was simple and convenient to analyse. This meant organising the questionnaire form so that it would be easy for me to record and discuss the results. †¢Practical details I needed to know how many copies of the questionnaire I would need and how I was going to ensure the maximum return completed questionnaires. †¢Anonymity I established whether the questionnaires were going to be anonymous. In case of anonymity, people might be more honest and informative in their responses. In case of non-anonymity, I might have been able to have follow-up interviews on selected questionnaires. I might also have been able to send reminders to those who had not responded. Questionnaire Design †¢Clarity It had to clear the informants why they were filling in the questionnaire: what was intended to achieve. It had to be clear whether or not the questionnaire was supposed to be anonymous. The instructions had to be very clear and explicit. The informants had to know whether the answers were to be ticked, crossed, circled or written out and where. †¢Simplicity I needed to know whether the questionnaire was laid out in a straightforward manner and whether the layout helped respondents to find their way through it. †¢Types of questions Questionnaire items can be relatively closed or open ended. A closed item is one in which the range of possible responses is determined by the researcher. In contrast, an open item is one in which the subject can decide what to say and how to say it. Questionnaires can consist entirely of closed questions, entirely of open questions, or a mixture of closed and open questions. The advantage of closed questions is that they usually make the questionnaire easier and quicker to fill in. they also make for quicker and more reliable scoring of the responses. The disadvantages of the closed questions are that they usually take longer to devise than open questions. Instructions on how to answer them have to be very clear. This means that the questionnaire designer has to anticipate all or most of the possible answers, so there may be little unexpected information in the responses. One corresponding advantage of open questions is that they are comparatively easy to design, but one may have some difficulties in trying to score and analyse the responses. It is also likely that responses to open questions reflect what the respondent wants to say. †¢Relevance Probably the most frequent mistake in designing questionnaires is asking unnecessary or irrelevant questions: for example, wanting to know whether the respondent is male or female, when his information has nothing to do with the purpose of questionnaire. †¢User – friendliness A lot of what I have been saying can be summarised by making the point that, since no one enjoys answering questionnaires, they should be made as ‘user – friendly’ as possible. This means they should not be too long, they should not be intensive (e.g. by asking questions that may embarrass the respondents) and they should not be confusing or perplexing. Piloting the Questionnaire An issue that affects questionnaires is that they should be piloted to see whether they work as planned. Even if I was going to distribute only a small number of questionnaires, I had to try them out on one or two people beforehand. In the piloting stage, I inquired: †¢whether the instructions were clear and easy to follow; †¢whether the questions were clear; †¢whether the respondents were able to answer all the questions; †¢whether the respondents found any of the questions irrelevant, patronising or irritating; †¢how long the questionnaire took the respondents to complete; †¢whether the respondents had any comments or suggestions that would help to make my questionnaire more effective. I piloted my questionnaires on two students. Drawing on the lessons learnt from the pilot I made the following changes: †¢I gave clear written instructions; †¢I eliminated questions five and six as they weren’t very clear and their answers were included in the variants of question seven †¢I changed the third variant from question three. Instead ‘uncomfortable’ I used the term ‘embarrassed’ as I thought that when producing an error students might show a sensation of embarrassment. This may be the result of teacher’s and even their classmates’ presence, more than a sensation of discomfort, which cannot be clearly defined. The questions that were unclear were given clear instructions about how to answer them. I tried to make my questionnaire user-friendly by changing the introduction. The questionnaire for learners was given in Romanian, as my subjects were beginners. As I was interested in teachers’ opinions I constructed a separate questionnaire. I piloted it on one teacher. After the piloting stage I made the following changes: I made my questionnaire user friendly by changing the introduction and I gave clear instructions about how to answer the questions. In addition I made a questionnaire for native speakers of Romanian as I thought that by administering it I might get useful and interesting opinions that could help me draw some conclusions concerning error correction in general and not necessary in the context of teaching / learning English. Question 2: to find out what importance students give to error correction Question 3: to see how they feel when committing an error Question 4: to see whether they learn from their errors Question 5: to see what correction techniques students usually prefer Question 6: to find out which correction techniques students find more useful Question 7: to see whether they are interested in the errors committed Question 8: to find out what colour students prefer the teacher to use when providing correction Questionnaire for teachers of English Question 1: to know what is the respondents’ experience in teaching English Question 2: to see how they found teaching English Question 3: to find out what colour teachers use when providing correction Question 4: to find out the way in which correction is carried out Question 5: to find out the way in which they correct errors Question 6: to know what correction techniques teachers use in classroom Question 7: to find out which of the correction techniques teachers find to be more useful Question 8: to see whether they are aware of students’ feelings concerning correction Question 9: to know what they think to be the results of correction Questionnaire for native speakers of Romanian Question 1: to find out the respondents’ age Question 2: to know how they find learning a foreign language Question 3: to see what importance they give to correction Question 4: to see their attitudes when committing errors Question 5: to see whether or not they learn out of correction Question69: to find out what correction technique they prefer Question 7: to see what correction techniques have a greater utility Data Analysis I have administered the questionnaires to 10 students (beginners, studying English as a foreign language), 10 teachers of English and 10 native speakers of Romanian. When selecting the teachers I thought of getting answers from different ones, that is from middle school teachers, high school teachers and even university teachers. I also chose teachers being in their first years of teaching and experienced ones. The native speakers of Romanian were selected on the following criteria: they had nothing in common with the context of teaching / learning and they did not learn any foreign language except for the period when they were students, but they do not use it anymore. Quantitative Data Analysis The questionnaire for learners of English Q1. Nine students consider English as being easy to be learnt and one student considers it difficult to learn. Q2.All the students say that it is very important ‘being corrected’ Q3. Seven students feel encouraged when their attention is drawn to errors committed, while three students feel discouraged about this. Q4. All the students argue that they learn from their errors. Q5.Seven students say that they prefer to be corrected only by the teacher, while three prefer to correct themselves after the teacher has indicated the errors. Q6.All the students consider that they learn more from the correction provided by the teacher. Q7.All the students say that when they get back their papers with correction provided by the teacher, they look at them in order to avoid the errors committed. Q8.All the students say that they prefer their teacher to use a red pencil when correcting their work. The questionnaire for teachers of English Q1.Five respondents have been teaching English between 0-3 years, four between 4-6 years and one for more than 10 years. Q2.Seven teachers find teaching English to be difficult, while three find it easy. Q3. Eight teachers say that they use red colour when correcting students’ work and one teacher says that he / she uses a pencil when doing this. Teacher 4 says that he / she uses both red and blue. Q4.Five teachers write in the correct form when correcting errors, four give hint what it should be and two simply indicate something was wrong. Q5.Four teachers write in the correct form when correcting errors, four give hint what it should be and two simply indicate something was wrong. Q6.Three teachers say that they use only teacher correction in classroom, while two say they use peer correction. Five teachers use more than a correction technique. Here are their answers: Teacher 1 uses both self-correction and peer correction. Teacher 4 uses peer correction and teacher correction. Teacher 5 uses self-correction and teacher correction. Teachers 6 and 7 use all the techniques. Q7.Six teachers consider that self-correction helps students improve their knowledge, one teacher considers that it is peer correction that helps students and one teacher considers that teacher correction helps students more than the other two correction techniques. Teacher 6 considers that all types of correction techniques help students, while Teacher 7 considers that only self-correction and teacher correction is useful. Q8.Four teachers say that the students feel discouraged when given back a paper full of corrected errors, four say that students feel embarrassed, while two say that students feel encouraged. Q9.Eight teachers think that students learn from the corrections they provide for a written paper, while two teachers think that students don’t learn from this. The questionnaire for native speakers of Romanian Q1.The respondents are between 22 and 57 years old. Q2.Six of them find easy to learn a foreign language, while four find it difficult. Q3.Nine respondents consider correction as being very important, while one respondent ranks it as important. Q4. Nine respondents say that they feel embarrassed when their attention is drawn to errors committed while one respondent feels encouraged about that. Q5.All the respondents say that they learn from the errors they usually commit. Q6.Five respondents express their preference for self-correction, while five prefer to be corrected by other people. Q7.Five respondents argue that they learn more from self-correction and five say they learn more from the correction provided to them by other people. Qualitative Data Analysis The learners of English and the native speakers of Romanian consider learning a foreign language, English in this case, to be easy. Conversely, the teachers consider teaching English to be a difficult task. All the respondents consider being very important to be corrected when committing an error. That is why they argue that they usually learn from the errors committed in order to avoid them. Both learners and teachers of English showed their preference for teacher correction in the classroom. However, few students prefer self-correction, but only after the errors have been indicated to them by the teacher. I consider that to be a different way of teacher correction, a more blurred one. What I mean is that teachers should give learners a free hand in correcting errors, but also in getting them used to the identification of errors. I think this is one of the reasons why students, although some of them prefer self-correction to be used, argue that they learn more from the corrections provided by the teachers. They are not accustomed yet to freely express their opinions and I would argue that this might be owing to the tradition of learning in Romania. However, teachers argue that students learn more from self-correction. Taking into account the ideas provided by Julian Edge (1993:10) regarding self-correction: ‘People usually prefer to put their errors right than be corrected by someone else. Also, self-correction is easier to remember, because someone has put something right in his or her own head’, one may say that teachers are absolutely right when maintaining this point of view. But how can students learn more from self-correction if the majority of teachers argue that they usually prefer teacher correction as a technique? However, there are some teachers who use self-correction in classroom, while some use peer correction. Of course, when using peer correction one must keep in mind the disadvantages of this technique. Regarding the way in which teachers correct learners’ written work it was surprising to find out that some, not too many anyway, do not correct any of the errors committed, but simply indicate, probably by means of symbols or underlining, that something was wrong. They use red for correcting errors and this is in agreement with learners’ expectations about this matter. The utilization of a different colour, when correcting errors, that is red, may be explained as a way of making students be more aware of the errors they commit. As a conclusion of the matter of correction techniques, I consider that all of them (i.e. self-correction, peer correction and teacher correction) should be used in classrooms, either when correcting written work or speaking. That is why some of the teachers who were administered the questionnaire chose more than one answer to the question dealing with this issue, being aware of certain advantages, and even disadvantages which, of course when noticed, should be avoided while using one or another correction technique. The following table summarises the respondents’ attitudes towards the correction techniques and their usefulness.

A well structure situated at the sea, some distance from the shore is known as an offshore well. This well is normally drilled at the seabed using specially designed drilling equipments and different drilling techniques are used. What are deviated wells, doglegs? A deviated well is a horizontal well drilled at an angle usually greater than 80 degrees to the vertical. It involves drilling horizontal and slant-hole wells which enhance better intersection of vertical structures in tight formations. Deviated well is essential since it prevents the fracture of vertical lines, which enhance the permeability of natural gas much higher than the unfractured rock. They increase production rate and minimize cost of ecological damage. Deviated wells can be grouped as unintentionally deviated and intentionally deviated. Unintentionally deviated implies that the well lies on a vertical or near a vertical plane. A dogleg is a sharp deviation or bend in a well’s direction or inclination. They are characterized by being abrupt, decreasing or increasing, excessive long and permissible. It can also referred to as an elbow . . Include a section on offshore well structure /design explaining how it is designed Offshore well structures are designed to bear up all foreseeable conditions which may be weather related as well as environmental loading factors such as earthquake induced loads. Accidental loads such as collisions, fires and explosions are also considered when designing a well structure . In designing this, a floating offshore structure which is polygon shaped and used for drilling or production purpose is used. It contains apertures on its sides meant for reducing the movement of the structure as a result of undersea currents. The structure further consists of a production platform extending above the water surface, and a series of buoyancy tanks which provide the structure with the ability to float. Apertures, surrounded by coamings, is located on each side of the structure to allow ocean currents to flow laterally through the center of the structure. It also makes it possible and easy for oil and gas can dissipate from the center of the structure if a rupture occurs. A fluid retention tank and ballast in the structure lowers the center of gravity of the structure and make it more stable, and a centerwell running through the longitudinal center of the structure allows one or more risers to run from the ocean floor to the operating platform. The structure can then be moored to the sea floor through the use of a catenary mooring system. . Unfortunately, in many cases the state will simply terminate the threat regardless of the potential and often assured possibility of another gadfly becoming a persistent irritant in speaking against the state. His use of God as a defense is admirable and show s a persistent desire to enlighten even the most hard headed of the state’s prosecution against him. If one believes in a God or Supreme Being then it stands to reason that his appearing as an irritant that can potentially cause many problems is given by God. â€Å"For if you kill me you will not easily find a successor to me, who, if I may use such a ludicrous figure of speech, am a sort of gadfly, given to the state by God† (Plato, 399 BCE) In addition to his appeal to a higher power is his appeal to singular ability with the line, â€Å"You will not easily find another like me, and therefore I would advise you to spare me† (Plato, 399 BCE). And he is right, for every human is irreplaceable as every human is singularly unique. Unfortunately, this argument goes against the other arguments regarding the likelihood of additional gadflies appearing and continuing the harassment of the state. For if he is truly unique then one can rightly assume that it is likely h e will not be replaced. More importantly is the thinly veiled message to the state, while it may feel good ridding itself of a stinging, biting nuisance for a while this is no long term solution to any problem. Easily equated to this are the modern movements speaking against state excess and immorality of conflicts and more; while the message is not easily accepted or acted upon by the state, it may become necessary to stop the problem of the gadfly by cleaning up the horse. Again using a modern approach, to stop the protests, articles and various messages against the state it would seem that the easiest course for long term comfort would be the reduction of immoral wars and greed. Plato uses the literal idea of death faced by Socrates both during and after his trial in order to develop the more philosophical concept of philosophy as a pursuit of death. For Plato, the melete thanatou involves the lack of a true fear of physical death but more a fear that the knowledge obtained and p assed on by himself will be lost. â€Å"I were to desert my post through fear of death, or any other fear; that would indeed be strange, and I might justly be arraigned in court for denying the existence of the gods, if I disobeyed the oracle because I was afraid of death, fancying that I was wise when I was not wise† (Plato, 399 BCE). Although, a few statements such as the above idea that one can prevent one's offspring from genetic deformities and disease, may be arguably an example of either pathos or ethos. The overall essay however, deviates from both. In addition, the essay is somewhat choppy and therefore lacking in logos (argument through speech). If the piece had been more eloquently written, one may be able to find it more persuasive. This is not to say that some of the statements here and there are not worded reasonably well and therefore slightly convincing. For example, Wood discusses that the process of creating his genetically engineered "utopia" would take place in stages and eventually appeal to everyone "Almost every one of the myriad incremental steps toward utopia appeals to some value such as competitive advantage or convenience". This causes the reader to wonder if perhaps they are not being open minded enough or perhaps they have missed the greater picture. This is an example of logos (argument and persuasion through speech. We had to sleep on the floor, which was hard and uncomfortable. The only way I stayed sane was thinking of succeeding at the American dream and returning to Sicily as rich as some of the tourists! When the ship docked in Brooklyn a very kind and hospitable man named Tony Bereli met us at the pier. He dropped us off at Beatrices house were we are temporarily staying. I was surprised at how nice Beatrices house was after Bereli described it as a slum. Over here in America people live in apartment blocks and estates instead of the shacks were used to back home. New York is a great city. At first I was some what taken aback by the citys daily hustle and bustle. Its so different from the town in Sicily where we know everyone. Beatrice looked very pleased to see us and asked after you and the childrens welfare. She introduced us to her niece Catherine who has stayed with them all her life as her parents died when she was very young. They were both very welcoming but Beatrices husband Eddie seemed as though he was a bit uneasy with our presence. Eddie told us about working on the docks as a longshoreman. He said we could earn up to forty dollars a week! The house is small with five people in it but I cannot complain otherwise I would be out on the streets. I am pleased to say both Rodolpho and me have found work as longshoremen loading and offloading things from other countries like coffee and tea. Whenever I get paid I will send the money home for you and the children. The main things I miss apart from you and the children are the scenery and the warm weather. In New York its cold with wall-to-wall skyscrapers. Rodolpho has taken to the bright lights of New York like a duck to water. He and Catherine seem to have something going on. Last week she took him on a grand tour of the city ending up in up in the Paramount Cinema. They arrived back at about midnight, Eddie was furious. He said Catherine had never been out so late. Eddie is too over protective of Catherine; he treats her like a kid! Its as if he is trying to keep Catherine for himself! Eddie treats Rodolpho like dirt. He insulted him calling him Danish because of his blonde hair. Eddie then went on to teach Rodolpho boxing classes in which he gave himself a good excuse to beat him up. Unprovoked incidents like these anger me. I wanted to get up and defend Rodolpho but didnt want to offend Beatrice. I asked Eddie if he could lift a chair from the bottom, he failed to do this. Then I lifted the chair over my head and looked him in the eye. This was my way of gaining a physical and mental advantage over Eddie. The look of defeat on Eddies face was a picture! How are Maria and Luigi? I am missing them so much. As soon as I get paid I will send money so you can buy Luigi some money for his chest. Tell them I wish I could be with them but I had no choice about leaving, wed have starved otherwise. I am working overtime everyday so I can come home to you and the kids soon. Transnational Organized Crime

Transnational Organized Crime 1) Describe the role and function of the Transnational Organized Crime Convention and the Convention’s relationship to its Protocols. The United Nations Convention Against Transnational Organised Crime (also known as the ‘Palermo Convention’) has attached to it the Protocol Against the Smuggling of Migrants by Land, Sea and Air 2000, the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, and the Protocol Against the Illicit Manufacturing and Trafficking in Firearms, Their Parts and Components and Ammunition. The United Nations Convention Against Transnational Organised Crime was adopted by General Assembly resolution 55/25 of 15 November 2000 and is â€Å"the main instrument in the fight against transnational organized crime†. It entered into force on 29 September 2003. States that ratify the instrument commit to taking a series of measures against transnational organized crime, including the creation of domestic criminal offences; the adoption of new and sweeping frameworks for extradition, mutual legal assistance and law enforcement cooperation; and the promotion of training and technical assistance for building or upgrading the necessary capacity of national authorities. The United Nations Convention Against Transnational Organised Crime and its Protocols are not human rights instruments in themselves, but have instead been described as providing â€Å"treaty framework to help states unite to combat transnational organised crime†. One commentator views the Convention and its Protocols as a framework of guidance which needs â€Å"filling in†, particularly in the areas of the exchange of information, the registration of biodata and the building of common entrance policies. The Protocols are not binding upon signatories of the Convention itself unless the signatory also becomes a party to the Protocol. The United Nations Convention Against Transnational Organized Crime states itself that its purpose is â€Å"to promote cooperation to prevent and combat transnational organized crime more effectively†. Article 3 provides that the Convention applies to a range of offences that the Convention criminalizes when they are transnational in nature, and then spells out that such an offence is transnational in nature if: (a) It is committed in more than one State; (b) It is committed in one State but a substantial part of its preparation, planning, direction or control takes place in another State; (c) It is committed in one State but involves an organised criminal group that engages in criminal activities in more than one State; or (d) It is committed in one State but has substantial effects in another State. The Protocols then add to the list of crimes contained in the Convention. As Kofi Annan states in the foreword to the Convention Against Transnational Organized Crime, â€Å"Criminal groups have wasted no time in embracing today’s globalized economy and the sophisticated technology that goes with it. But our efforts to combat them have remained up to now very fragmented and our weapons almost obsolete. The Convention gives us a new tool to address the scourge of crime as a global problem. With enhanced international cooperation, we can have a real impact on the ability of international criminals to operate successfully and can help citizens everywhere in their often bitter struggle for safety and dignity in their homes and communities.† 2) What do we mean by the term ‘securitisation’ of transnational crime? Do you think policies that ‘securitise’ TNC are useful? In basic terms, the securitisation of transnational crime means the movement of legislative bodies from viewing crime in a cultural, social, economic and/or legal context to viewing transnational crime as a matter of national security. The Copenhagen School defines the concept of securitization: â€Å"Securitization refers to the process of presenting an issue in security terms, in other words as an existential threat†. Transnational crime may be presented as an existential threat to the security of nations through the discourse that political leaders utilise, but also through others. Transnational crime has been referred to as a security issue in the academic literature. McFarlane and McLennan claimed in 1996: â€Å"Transnational crime is now emerging as a serious threat in its own right to national and international security and stability†. In modern times, forms of transnational crime in the Asia Pacific have been securitized that is, represented by policy elites and security actors as crucial or existential threats to national and regional security. At the first summit of ASEAN heads of state and government held in Bali in 1976 President Suharto declared: â€Å"Our concept of security is inward looking, namely, to establish an orderly, peaceful and stable condition within each territory, free from any subversive elements and infiltration, wherever their origins may be†. Galeotti has recently indicated that â€Å"the struggle against organized and transnational crime will be the defining security concern of the twenty-first century†. As Emmers states â€Å"transnational crime poses a threat to states, national economies and civil societies.† He provides the example of non-state actors using terrorism to promote their political causes. In his opinion the groups are able to gain strength from their ability to forge links across national boundaries and in turn are able to threaten national sovereignty and the integrity of independent states with the result that they can effectively threaten the survival of the governments of those states. However, it is not just terrorism which may be ‘securitized’, other forms of transnational crime affect states and their societies. As Emmers again notes, â€Å"drug trafficking and money laundering reduce a government’s capacity to govern, weaken the credibility of financial institutions and undermine social order†. Nevertheless, Emmers has also expressed the opinion that the problem of transnational crime could be dealt with more effectively if it was approached primarily as a criminal matter rather than as a security issue. He notes that the concept of securitization of transnational crime can work better in some nations than others, depending on the commitment shown by those nations to tackle transnational crime in a security driven way. Comparing the US and the ASEAN states he says that in the US the securitization rather than the criminalization of terrorism has allowed the US to use more traditional security responses against al-Qaeda, with the obvious rhetoric being â€Å"War on terror†. It may therefore be argued that where a state is prepared to tackle transnational crime in traditional, often military, ways, policies that securitize transnational crime are indeed useful. However, it has been argued by Emmers that where states are not prepared or are unable to tackle transnational crime in a traditional security based way, criminalization rather than securitization, should take precedence. As Emmers states: â€Å"In the context of Southeast Asia, ASEAN may be advised to further rely on the criminalization of transnational crime, as it does not dispose over the collective will, joint political instruments and military capabilities to match its rhetorical claims about security†. He also argues that transnational crime being seen in a criminal context rather than a security one could lead to better results. In his 2002 paper he suggests that criminal activity cannot be solved by resorting to the traditional security means, such as army activation and concludes: â€Å"The US war on drugs in Columbia and its failure to reduce the supply of narcotics in America is testimony to that reality.† 3) Briefly describe the role of globalisation in modern TNC. In order to describe the role of globalisation in modern transnational crime, it is useful to consider what ‘globalization’ really means. As Gros states, â€Å"globalization does not mean the same thing to all people† and therefore there is â€Å"confusion around what it is and what it does†. Gros defines globalization as â€Å"the deregulation of national economies and financial markets, on the one hand, and their international integration under the aegis of free-market ideology on the other†. In policy terms, globalization often entails the deregulation of capital flows, eviction of the state from areas that concern production and the privatization of former state-owned enterprises, reduction in the size of government, trade liberalization and the creation of large trading blocs. Wright argues that the globalization of business serves to foster organized crime. He states that â€Å"In the case of organized crime (and arguably in the case of international business ethics) we should not be surprised at the failure of the invisible hand of the market to control malpractice.† Furthermore, he states that it is â€Å"for this reason, at least part of the solution to the problem of organized crime is not connected to law enforcement at all It is connected to the further development of the free associations of civil society which can influence government policy and eventually relegate organized crime to the status of a fringe activity.† The impact of globalization on transnational crime can be seen by looking at examples from previously communist and less capitalist regimes. As Sanz and Silverman explain, in the past 30 years or so Communist countries throughout Asia and the Pacific rim have moved toward a more capitalist economic system. These countries’ business communities have welcomed capitalism because it provides more entrepreneurs to achieve greater independence and a richer standard of living. This economic shift in turn receives support from foreign investors. Furthermore, the general population also embrace the capitalist system because it is able to provide new goods and services. As Sanz and Silverman conclude, â€Å"such changes bring us closer to a global economy which will open new markets and expand opportunities for both legitimate and criminal entrepreneurs†. This can be seen in Poland where, â€Å"many new kinds of economic and financial crimes appeared along with the free-market economic system – crimes that had been typical and known for decades in capitalist countries but which had not appeared in Poland for the past 45 years†. The voluntary relaxation or involuntary loss of state control domestically and at international borders coupled with the fact that mechanisms of state governance and incidents of sovereignty have been lost, altered, or sacrificed to produce domestic economic change and promote international trade mean an increase in the ease with which international criminals can operate. As Myers states: â€Å"while this is a gross simplification of the complex issues unique to each state individually, and to regional and global alignments generally, it points to salient factors, which have permitted criminal groups whose activities had domestic, regional or limited international impact to become transnational in scope.† 4) What role does technology play in modern TNC, both from the point of view of assisting TNC and assisting its interdiction? Following on from the impact of globalization on transnational crime is the impact of technological advances. As McFarlane comments, technology enables and increases the capacity of â€Å"transnational organised crime and terrorist groups to exploit advances in electronic banking, encryption, telecommunications, developments in global travel and commerce, and †¦ visa free regimes†. Furthermore, it may be difficult for law enforcement agencies to keep pace with the developing technologies which are capable of being exploited by criminal groups. As McFarlane states, â€Å"transnational organised crime and terrorist groups are usually small and flexible organisations capable of ‘buying the best brains’ to enable them to respond to new technologies more quickly than slow, bureaucratic government agencies†. One particular consideration is the technological advancement of travel (for example speed boats and aeroplanes). It is true that the technological advancement of transportation has had the effect of bringing Southeast Asia closer to Western markets with a quick and, relatively speaking, safe method of moving contraband. As Sanz and Silverman suggest, â€Å"global criminal ventures are now facilitated by the ease of catching a flight and quickly travelling to a country in which one is virtually unknown to the authorities†. As well as making contact between criminal organizations quicker and more accessible, allowing easily planned and accomplished transnational crimes, technological advancements also make the perpetration of certain crimes easier and has even brought new crimes into existence. Again, Sanz and Silverman comment â€Å"technological advancements†¦ make it easy to counterfeit nearly anything from currency to clothing to watches. Technology has also made it relatively easy to obtain a new identity. Medical advances have created a growing demand for human organs, while technological growth has created a market for trade secrets and information about new product research.† Since the break-up of the Soviet Union there has also been, of course, a development of a black market in high tech and nuclear weapons. In terms of transnational criminal finance, technology has had a very important role to play. As Glynn et al. (1997: 12) note, â€Å"the emergence of an electronic financial system markedly enhances opportunities for corruption, the difficulty of controlling it, and the potential damage it can inflict.† Indeed, Gros notes that anyone can move currency around the world, with at least some delay in being caught. He goes on to suggest that transnational criminal organizations are able to recognize opportunities not only in terms of transportation but also with regards the â€Å"fluidity of money markets† allowing for â€Å"movement of illicit profits in and out of countries that are at the epicentre of globalization.† However, technology is not all bad in the fight against transnational crime. For example, the tracing of transnational crime has been made easier by technology in that money can now be tracked across borders through the international banking system. See Dobinson for an interesting case study of how $40 million US dollars was traced across Australia and Hong Kong. Advances in technology also allow law enforcement agencies to update their national systems quicker, alert border control authorities and potentially enable the passing of information between states more efficiently, enabling transnational crime to be prevented, controlled and prosecuted more effectively. 5) What impact have the provisions for Mutual Legal Assistance and the Exchange of Information in the Transnational Organized Crime Convention had on the sharing of intelligence multi-laterally? As one commentator notes, â€Å"obtaining physical custody of fugitives means little absent the evidence needed to convict them at tria†l. MLATs provide assistance at all stages of criminal investigations and prosecutions. Available assistance under MLATs includes bank or other financial records, witness statements and testimony, search and seizure of people and things, and immobilization and forfeiture of the proceeds of criminal activity. As an example of how a MLAT has worked in practice, in 1997 the US made an MLAT request to Canada on behalf of prosecutors who were investigating a murder. Pursuant to the request, the US sought and obtained from the Canadian authorities the murder suspect’s car, copies of airline ticketing records, billing information and other evidence which was then used to secure a conviction. However, in the absence of a specific treaty provision, there is no mechanism whereby parties can be obliged to use formal mutual legal assistance provisions to obtain evidence abroad. In Re Sealed Case the US Court of Appeals rejected the argument that US law enforcement agencies were limited to obtaining evidence in accordance with the provisions set out in a mutual legal assistance treaty signed by the Swiss and US Governments. The appellant refused to comply with a subpoena to appear before a US court to produce documents relating to Swiss companies. Rejecting the argument that compliance with the request would be contrary to Swiss secrecy laws and in breach of international comity, the court held that it could ‘order any party within its jurisdiction to testify or produce documents regardless of a foreign sovereign’s view to the contrary. In Southeast Asia, the picture is complicated, with intelligence sharing and cooperation proving successful but only where the information is not of a nature that will challenge the political rulers of the states. As Emmers recently concluded, there has been success between Sinapore, Malaysia and the Philipines in the context of exchanged information, particularly leading to extradition proceedings. As recently as April 2007, Singapore and Indonesia signed an Extradition Treaty in order that terrorist suspects can be dealt with in the appropriate legal systems. However, despite these examples of bilateral cooperation, Southeast Asian states â€Å"resist sharing sensitive information on domestic matters that could embarrass or challenge the political positions of ruling elites†. Furthermore, difficulties in information sharing and mutual legal assistance may arise where there is a difference between the legal systems of the relevant states. For example, countries which have no mutual legal assistance treaties with Italy have tended to attract Mafia criminals, yet even where agreements have been in place other members of the Mafia have been able to live openly despite the existence of serious criminal charges outstanding against them. Jamieson provides an example of when the jurisdiction of the requested country does not acknowledge the Italian crime of membership of a mafia-type association or, as in the case of the Netherlands and Germany, where crimes of conspiracy do not exist there is a loophole created. The case of the camorra member Michele Zaza exemplified this: Zaza was wanted in Italy since 1984 on charges relating to his purported Mafia association, as well as murder and drug trafficking. His extradition was sought by Italy, however, he was allowed to live openly in France (apart from serving a two year sentence for cigarette smuggling). In fact it was not until 1993 that he was finally re-arrested and extradited to Italy, where he later died in jail. Given this relationship between PCr resynthesis and recovery of power output, supplementation is most likely to be beneficial to repetitive sprint activities (Glaister, 2006). However, some investigations on the effects of creatine supplementation and its effect on multiple sprint performance report significant improvements, whereas others report no such effect (Mujika, 1996). The main reasons for discrepancie s in the results of different investigations are the use of low subject numbers, varied creatine doses, varied test durations, and poor randomization. For these reasons this study will use a high number of subjects in a double blind fashion, with a dosage of 20 grams per day for the first 5 days followed by 5 grams a day for the remainder of the study. The study will continue for a duration of 8 weeks. Creatine monohydrate supplementation is popular in athletes participating in strength and power sports. Creatine use is thought to be effective for enhancing performance of activities that involve repeated intervals of sprint type exercises with short rest periods. First, an increase in PCr stores should increase the contribution of PCr for the resynthesis and decrease the demand from glycolysis which will result in a smaller accumulation of lactic acid. Then, when PCr is broken down to rephosphorylate ADP, a hydrogen ion is consumed in the reaction. Therefore, an increase in PCr could delay the onset of acidosis and fatigue and thus improve performance in repeated bouts of sprinting (Chilibeck Cornish, 2006). A study performed on the sprint performance of 19 highly trained male soccer players using creatine supplementation, consisted of six maximal 15 meter runs with a 30 second recovery period. The results of the study allowed the investigators to conclude that acute Cr supplementation favorably affected repeated sprint performance, however intermittent endurance performance was not affect by Cr (Mujika Padilla, 1998). Another study done by Mujika in 1996, involved sprint performance among twenty highly trained swimmers. Unlike the other studies mentioned, this study showed no significant improvements in sprint performance among competitive swimmers, therefore according to these results creatine supplementation cannot be considered as an ergogenic aid (Mujika, 1996). A study using the 30 second maximal cycle test, also known as the Wingate test, in conjunction with creatine supplementation also showed no ergogenic benefit. 20 grams of creatine supplementation for 3 days did not increase resting muscle PCr, nor did it affect the single short term maximal cycling performance. A possible explanation for this is that the duration of the test was too short to produce and significant muscular changes (Odland et al., 1997). Most studies have investigated the effects of creatine supplementation using cycle ergometry, this study will involve actual sprinters performing repeated sprints with relatively short rest periods performing to exhaustion. Also, there is little to no research on the prolonged effects of creatine supplementation, so the length of the study will be 8 weeks. STATEMENT OF THE PROBLEM: While many studies exist pertaining the effects of creatine supplementation on strength, power, and endurance, few studies exist investigating the effects of creatine supplementation on sprint performance on trained sprinters. The results of prior studies have noted many discrepancies such as research done by Mujika (1996) and Glaister (2006). Not enough evidence exists on the effects of creatine supplementation on sprint performance specifically the effect it has on trained individuals. PURPOSE OF THE STUDY: The purpose of this study is to examine the effects of creatine monohydrate supplementation on sprint performance in 50 NCAA colligate track and field athletes. These participants will go through an eight week supplementation and training period where they will be timed pre and post supplementation on a weekly basis in the 100 and 200 meter runs. SIGNIFICANCE OF THE STUDY: Most research on creatine has focused on short-term creatine loading and its effect on high intensity performance capacity. Some studies have investigated the effect of prolonged creatine use during strength training. However, studies on the effects of prolonged creatine supplementation on sprint performance are lacking. Due to this lack of information, this study will provide more data on the effects of prolonged creatine supplementation and its effects on sprint performance. RESEARCH HYPOTHESES: There will be a significant difference between the group which supplements with creatine and the control group in term of improvements in sprint performance. Improvements will be considered to be an improvement in time trials. The creatine group will have significant improvements in sprint performance compared to the control group. There will be more of a significant improvement in the 200 meter sprint times as opposed to the 100 meter sprint times. These improvements are generally attributed to increase total creatine and phosphocreatine content in working muscles leading to more efficient resynthesis of PCr and enhance quality of training adaptations. Recent investigations by Mujika and Padilla (2000) have focused on the possible ergogenic value of supplementing the athletesà ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ãƒ ¢Ã¢â‚¬Å¾Ã‚ ¢ diet with approximately 20 g/d of creatine monohydrate for a week. It has often been shown that this type of creatine supplementation can result in increased total muscle creatine and phosphocreatine concentrations. Some studies have also shown that this elevated intramuscular phosphocreatine can enhance the rate of ATP and phosphocreatine resynthesis after high intensity efforts, causing a delayed onset of muscular fatigue and an increased performance during repeated bouts of high intensity exercise. A study stimulated by anecdotal reports of gains in strength and lean body mass in conjunction with Cr supplementation investigated the use of lower doses of creatine monohydrate for extended periods during heavy resistance training. There were no changes observed in body mass for the control or placebo groups, while the Cr groups had in average increase in body weight by 2 kg. The results of this survey included; 35.3% reporting being fatigued less quickly, 29.4% reported quicker recovery from sprint type activities, and 23.5% reported faster recovery from training sessions. The study concluded that Cr supplementation may be useful in sports which require repeated sprint efforts and can be advantageous in both training and performance (Meir, 1995). It has been suggested by Mujika et al. (2000) that highly trained athletes who participate in sports in which performance relies on repeated efforts could benefit from creatine ingestion by means of an increased ability to perform intermittent high-intensity exercise either during training or competition. There have also been recent reports claiming that most studies not only do not use highly trained athletes as subjects, most of the studies cited above were conducted under laboratory conditions, and none of them assessed the effects of the creatine supplementation on performance during single specific athletic events. Recently reported results suggest that highly trained subjects performing sport-specific activities do not benefit from creatine ingestion (Mujika, 1996). There have also been a number of studies which report no ergogenic benefit from Cr supplementation. For example, one study by Burke et al. (1996) used male and female swimmers from the Australian National Team who supplemented with Cr for a 5 day period using 20 grams each day. This study did not show any enhancement due to Cr supplementation in 25m,50m, or 100m swims with a 10 min recovery period. Given such a long recovery period, ATP recovery should be recovered with our without Cr supplementation, therefore an increase in performance is not expected. A similar study involving swimmers was conducted by Mujika in 1996. This study also reported no performance increases between Cr and placebo groups, but did report a gain in body weight among the Cr group. This increase in weight could result in a increase in drag force and could alter the efficiency of a swimmers stroke. A study pertaining to maximal sprint performance on a cycle ergometer after Cr supplementation was conducted by Snow et al. (1998) The subjects were untrained men, who ingested 30 grams of creatine for a 5 day period. These results are supported by similar studies by Finn et al. (2001) and Odland (1997). A recent study done in 2003, by Delecluse et al. examined the impact of a 7 day, high dosage of Cr supplementation on single and intermittent sprint performance in highly trained sprinters. Each subject ingested 0.35g of Cr per kg of body weight. Maximal sprint performance, degree of fatigue at the end of exercise, and degree of recovery all showed no difference compared to a placebo group. A review of previous studies concerning the topic of Cr supplementation show that Cr has been show to be a powerful aid in increasing strength and power related to sprint performance. Other studies however, have shown no improvements in strength, power, or overall sprint performance in conjunction with Cr supplementation. These discrepancies in results can possibly be attributed to differences in length of supplementation, exercise criterion, dosages, or subject response. METHODOLOGY: SUBJECTS: An email was sent to ten different division one schools asking their coaches if their track team would be willing to participate in an off-season supplementation program within a study that is being conducted at the University of Scranton. Due to the lack of a track and field team, we had to contact other schools in the area and see if there track team would participate. The coach from Lehigh University responded allowing his team to participate in this supplementation program. A written consent was obtained from the all 50 participants after they were thoroughly informed of the purpose and potential risks of participating in the study. All experimental procedures were approved by the Exercise Science Committee of the University of Scranton. All subjects were members of the same team and were competing at a national level at the time of the study. TESTING PROCEDURES: All of our testing will take place at the University of Scrantonà ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ãƒ ¢Ã¢â‚¬Å¾Ã‚ ¢s gym facilities. This study will use a pretest-posttest randomized-groups design. Our subjects will be evenly divided into two groups. One will be the control group, and the other the experimental group. Both the researchers and subjects will lack information as to which group is which. Each group will come in for a pre-training assessment evaluation that will last the first week of the study. Each participant will be timed in the 100 and 200 meter runs to establish prior times and speeds before supplementation begins. All of the timed trials will be supervised by experienced exercise physiologists found in our team here at the University of Scranton. During weeks two through seven is when supplementation will occur. Creatine (Cr) monohydrate will be administered to the supplementation group. This supplementation group will ingest four 5-g doses of Cr monohydrate per day for 6 days. The control or placebo group will take the same dosage of a carbohydrate solution as the supplementation group. Each sprint will begin on the blocks, and once the sprint has commenced, subjects will pass through a photocell gate (Newtest OY, Oulu, Finland) placed 0.4 m above the ground, which will start a digital timer. Additional photocell gates will be placed at 5 m and 15 m, which record elapsed and final times. Intermittent endurance test (IET). This testing procedure was also done by Mujika et. all in 2000 that was also appropriate for the training regimen in this study.
